Terms of Service

These Terms of Service ("Terms") are an agreement between you and Maroof LLC ("Mailiya", "we", "us"), a limited liability company organized in Virginia, USA, and govern your access to and use of the Mailiya website, console, APIs, SMTP service, and template marketplace (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Your account

You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 18 years old and able to form a binding contract. You are responsible for the acts of anyone you allow to use your account.

2. Acceptable use

Your use of the Service must comply with our Acceptable Use Policy, including all anti-spam requirements. You may only send email to recipients who have consented to receive it, and you must honor unsubscribe requests. We may suspend sending that threatens deliverability or violates the policy.

3. Sending domains and authentication

To send email you must verify ownership of your sending domain and maintain the required DNS records (SPF, DKIM, DMARC). You are responsible for the content of every message you send and for compliance with applicable law in the jurisdictions of your recipients (including the US CAN-SPAM Act and, where relevant, GDPR and similar laws).

4. The template marketplace

Creators may list email templates for sale, and buyers may purchase them. Creators represent that they own or are licensed to sell what they list and that it does not infringe any third party's rights. When you buy a template, you receive a license to use and modify your copy within the Service; you may not resell another creator's template as your own. Mailiya facilitates these transactions and may retain a platform fee as described at the point of sale. We are not the author of creator-listed content.

5. Fees and payment

Paid plans and marketplace purchases are billed as described at the time of purchase. Fees are non-refundable except where required by law or expressly stated. We may change pricing with reasonable notice; changes do not affect the current paid term.

6. Your content

You retain ownership of the content you submit (email content, templates, recipient data). You grant us a limited license to host, process, and transmit that content solely to provide the Service. We handle personal data as described in our Privacy Policy.

7. Suspension and termination

We may suspend or terminate access for violation of these Terms, non-payment, or activity that harms the Service, other users, or recipients. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

8. Disclaimers

The Service is provided "as is" and "as available." We do not warrant that every message will be delivered or that the Service will be uninterrupted or error-free; email delivery depends on third-party mailbox providers outside our control.

9. Limitation of liability

To the maximum extent permitted by law, Mailiya will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the three months before the event giving rise to the claim.

10. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws rules. The courts located in Virginia will have jurisdiction over any dispute, unless applicable law requires otherwise.

11. Changes

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice. Continued use after changes take effect constitutes acceptance.
