Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets the rules for using Mailiya to send email and to participate in the template marketplace. It exists to protect recipients, our customers, and the deliverability everyone depends on. Violating it may result in throttling, suspension, or termination. This AUP is part of our Terms of Service.
1. Consent and anti-spam
- Send only to recipients who have given you permission to email them.
- Do not send unsolicited bulk email (spam) or purchased/scraped/rented lists.
- Accurately identify yourself; do not use false or misleading headers or subject lines.
- Include a working unsubscribe mechanism and a valid physical postal address in marketing email.
- Honor unsubscribe and complaint requests promptly; we suppress complained recipients automatically.
- Comply with applicable law, including the US CAN-SPAM Act and, where relevant, GDPR, CASL, and similar laws.
2. Prohibited content and activity
- Phishing, fraud, malware, or attempts to deceive or harm recipients.
- Illegal, hateful, harassing, or sexually exploitative content.
- Content that infringes intellectual property or privacy rights.
- Circumventing rate limits, warmup controls, or suppression lists.
- Reselling raw sending access in a way that evades this AUP.
3. Marketplace conduct
Creators must list only templates they own or are licensed to sell, must not include malicious code, and must not misrepresent what a template does. Buyers must not redistribute a purchased template as their own listing. We may remove listings that violate this AUP or infringe third-party rights.
4. Deliverability and shared reputation
Sending reputation is a shared resource. We may throttle, pause, or suspend sending that produces high bounce or complaint rates, spam-trap hits, or blocklistings — to protect other senders. Keep your lists clean and your complaint rate low (we recommend well under 0.3%).
5. Reporting abuse
To report a suspected violation or abusive message sent through Mailiya, contact abuse@mailiya.com. We investigate reports and take appropriate action.
6. Enforcement
We may investigate suspected violations and cooperate with law enforcement. We may act immediately, without notice, where sending threatens the Service or others. Enforcement decisions are at our reasonable discretion in line with these rules.
